The San Antonio Divorce Process: What to Expect

We arrange for the spouse to be officially served with the divorce petition in a manner consistent with legal requirements. Alternatively, we can assist with obtaining a waiver of service from the spouse.

The timeline for a divorce in San Antonio varies significantly based on the complexity of the case and whether it is contested or uncontested. An uncontested divorce, where both parties agree on all terms, can be finalized in as few as 60 days (the minimum waiting period required by Texas law).
Contested divorces involving disputes over property, child custody, or other issues can take several months to a year or more to resolve. Factors such as the court's schedule, the willingness of both parties to negotiate, and the need for discovery can all impact the length of the process.
In San Antonio, as in all of Texas, the primary consideration in child custody determinations is the best interests of the child.
Judges will consider a range of factors, including the child's physical and emotional well-being; the stability of each parent's home environment; each parent's ability to provide care and support; the child's wishes (if they are of sufficient age and maturity); evidence of any domestic violence or abuse; and each parent's willingness to co-parent and facilitate a relationship with the other parent.

While mediation is not strictly required in all Texas divorces, many judges encourage or even order parties to attempt mediation before proceeding to trial.
Texas is a community property state. This means that property acquired during the marriage is presumed to be owned equally by both spouses and is subject to division in a divorce. Separate property, which is property owned before the marriage or received as a gift or inheritance during the marriage, is not subject to division.
The court will divide community property in a just and fair manner, which is generally, more or less, a roughly equal division. However, the court may deviate from an equal division if there are compelling reasons, such as one spouse's misconduct or disparate earning capacity.

Fault grounds for divorce include adultery, abandonment, cruelty, and conviction of a felony. While proving fault can impact certain aspects of the divorce, such as property division or spousal support, it is often not necessary or advisable in a Texas divorce.
